Mr. Marella,
Today 11-23-09 we took possession of Hayyard Branch. I
have not heard
from you nor trainer/owner Brandon Jenkins regarding
this incident. We
incurred a $50.00 haul fee to bring Hayyard Branch to
our quarantine facility and
we do charge $10.00/day for holding. I am obligated to
pay for the horse
tomorrow. Brandon had the opportunity to retrieve the
horse from the LVLA
auction when we first reported/contracted you regarding
this and didn't.
As I explained the horse was slated to ship to
slaughter. The price of the
horse is $400.00. Since the horse is now at our
facility as our assistance
in retrieving from the slaughter pen was necessary, a
transfer of
ownership form is now required for lifetime protection
of the horse with followup

I am copying the R.A.C.E. fund on this email as we have
worked with them
with much success in helping OTTB's from Penn National
in the past and to
make them aware of the need for assistance for this
horse.
Please advise what we should expect to happen now with
the payment and
also your disciplinary action regarding the zero
tollerance policy which was
violated by this trainer with this horse.
Thank you for your time and attention to this matter. I
would appreciate
an answer at your earliest convenience as we don't have
the funds to pay
for this horse and will need to go public to raise
donations since we have we
have incurred exenses and have to pay for him tomorrow.
We were hoping
that our assistance would not be necessary after our
immediate notification
to you about this situation on Sunday am which was right
after the sale and
the message stating that Brandon was going to retrieve
this horse.

horse.

We have just received word that the horse has not yet
shipped to

I would also like to know what if any intentions you
have for Mr. Jenkins
as far as reprimand for his lack of following the track
rules of the
implemented zero tollerance policy. If you could
provide a quote which could be
used for our press release it would would be extremely
appreciated.
We do have a written form of protection that we drafted
for these
instances to help protect the horses. This form was
provided to Mr. Limongelli to
implement to protect the horses he gives away and we do
have a website to

conjunction with AC4H but specifically for
Thoroughbreds.

We are greatly appreciative of your assistance in this
matter. In Texas
and Pennsylvania and as a thrid generation horseman
which was printed in the
Post Times newsletter, I am quite sure that Mr. Jenkins
is aware of
auctions and of slaughter. After your telephone
message stating Mr. Jenkins was
going to attempt to or making an effort to retrieve his
horse we thought
our assistance wouldn't be necessary any longer.
I need to make you aware that I did followup and that
this horse was
purchased by a contracted kill buyer. He is checking
his lot we will have the
answer tomorrow as to if the horse already shipped or is
in the holding lot
to ship. If the horse did leave it would have left
Monday night and Mr.
Jenkins would have had ample time to retrieve his horse
as the auction where
the horse was sold was only approximately 15 miles from
Penn National Race
Track.
Should the horse still be alive I would expect Mr.
Jenkins would still
want to preserve his "good name" and stalls at the track
and purchase this
horse back correct? Again, I will know tomorrow if the
horse is still alive
so there is an urgency to know if Mr. Jenkins is indeed
going to abide by
the zero tollerance policy and if you are going to
enforce it.

Brandon did contact the sale at which he had left the
horse, only to find
out that it had been sold. My understanding, from
Christy or you, is that
the sale of the horse was held up due to some
uncertainty about the
paperwork. Brandon did not expect that the horse would
be held without food or
water, for any period of time. As matter of fact, that
was his first concern
when I contacted him, that if the horse was still at
the sale barn it did
not have food or water.
Brandon is relatively new to the area and says that he
did not realize the
potential for this horse to end up in the hands of
killer buyers. Our
Racing Secretary and I will have further conversation
with him about the issue.
Unfortunately we can not completely control some of
these circumstances.
While I appreciate your concern, to say that it was
"disturbing" to hear
that Brandon was making an "effort" is confusing, to say
the least. I was
under the distinct impression that the emails and phone
messages were
intended to cause an effort to be made. ....that they
were not merely
informational.
The email notifying me of the situation was not sent on
Friday evening,
but at 12:01AM Sunday. I did not see that email or
retrieve any voicemail
until mid-morning on Monday, at which time I contacted
Brandon.
I am more than willing to assist you in your efforts,
with the limited
ability that I have to do so, however I will not
continue to assist you if I
perceive that there is a continued lack of appreciation
for that
assistance.
Unfortunately, our efforts do not appear to have been
successful in this
case, though it is not a certainty that Hayyard Branch
ended up in the hands
of killer buyers.
